Trial Agreement
- NEL has full and unencumbered title and right to any evaluation software downloaded from this site (hereinafter referred to as the Package).
- The Company wishes to evaluate the Package and NEL agrees to allow access to the Package for a period of 30 days for this purpose.
- The Company undertakes that the Package will be used for no purpose whatsoever other than that stated at Clause 2 above and to keep confidential all information relating to the Package and not to disclose any information relating thereto to any third party. The duty hereunder shall, without prejudice to the generality of the foregoing, include physical protection and safeguarding from theft, unauthorized access, use or distribution and misappropriate or unauthorized disclosure. In the event of loss or damage to the Package, the Company will meet the full cost of replacement which will be the current standard price of the Package.
- The Company further agrees at the end of the trial period not to take copies of the Package supplied by NEL nor to make any further use for commercial gain thereof of the information supplied.
- This Agreement shall be governed and construed in accordance with English law and the parties hereto agree to the jurisdiction of the English Courts.
The Company acknowledges that it has read and agrees to be bound by the terms and conditions contained in this Agreement.
